The Legislative Treatment of Constitutional Inattention in Organizing the Parliamentary Government (Diagnosis and treatment: a study within the framework of the Iraqi constitution of 2005)

Abstract

Constitutions, no matter how detailed and codifying large number of constitutional principles and rules, are sometimes liable to legislative failure and inattention in some matters. In this regard, this study deals with the concept of constitutional inattention, the possibility of its occurrence, and the means by which it can be avoided or treated by enacting basic laws by the parliament. The study also highlights the areas of constitutional inattention observed in the Iraqi constitution of 2005, in relation to the organization of the parliamentary government with a proposal for possible legislative remedies for these gaps.
