The Early Marriage and Social Violence: A Comparative Analytical Study

Abstract
The Islamic legislator has given special attention to the contract of marriage due to its unique nature, which lies in the consequences that arise from it, affecting not only the woman but also all members of the family and society. Marriage is the means through which a man and a woman connect، and it obliges each of them to fulfill their respective rights and duties towards the other. It also serves as a means of cooperation between spouses, allowing them to share the burdens and responsibilities of life. Undoubtedly, marriages involving individuals under the age of eighteen occur in countries where the age of majority is reached before this age or at the time of marriage. Early marriage can also be attributed to situations where both spouses are eighteen or older but are not ready to consent to marriage due to factors such as their physical, emotional, sexual, and psychological development, or a lack of information about their life choices. To curb this phenomenon and empower women، the researcher addresses this issue by comparing and analyzing how the Iraqi legislator has regulated this problem، contrasting it with comparative legislation and the principles of Islamic jurisprudence.
