Abstract

The right of ownership was not an absolute right that could not be infringed، especially the ownership of agricultural land because of its connection to the necessities of life and what it was necessary to deal with in order to achieve the public interest even if this resulted in sacrificing the interests of certain individuals.


The right of the stream (watering) is the right of the owner of the land away from the water supplier to make sufficient water to irrigate his land in other land owned by others that are connected to the water supplier. This is expressly expressed in Article 1058 of the Iraqi Civil Code. The criminal guarantee is the decisions of the dissolved Revolutionary Command Council (1603) for the year 1981 and (906) for the year 1987, both objectively and procedurally, by a penalty of imprisonment for a period of not less than (5) years and not more than (10) years.
